Terms of Service

These Terms set out the rules for using Astryx. Please read them carefully — in particular the section on equipment and observatory safety, which explains the limits of what Astryx does.

1.Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of Astryx — the astrophotography planning and observatory-orchestration platform at astryx.space and app.astryx.space, including the API and the optional local agent (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2.What Astryx is

Astryx is a planning, scheduling, and monitoring layer that sits above the tools you already use (such as N.I.N.A., ASCOM/Alpaca, and INDI). It helps you plan targets and mosaics, schedule integration goals, organize equipment and projects, and view read-only telemetry from your observatory.

Astryx orchestrates and reports; it is not itself an acquisition controller. The local agent reports device and session status only — it does not issue commands that move or operate your equipment.

3.Your account

You must provide accurate information and be at least 16 years old (or the age of digital consent in your jurisdiction). You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access. Workspaces have role-based access (owner, admin, operator, viewer); if you invite others, you are responsible for managing their access.

4.Acceptable use

You agree not to:

  • Use the Service unlawfully, or to infringe others' rights.
  • Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure, or probe, scan, or test the vulnerability of any system without our written permission.
  • Interfere with or disrupt the Service, including by circumventing rate limits or abuse protections.
  • Reverse engineer or resell the Service except as permitted by law.
  • Upload malicious code or use the Service to store or transmit unlawful content.

5.Your content and data

You retain ownership of the data and content you create in Astryx (your equipment, projects, sites, image metadata, and similar). You grant us a limited license to host, store, process, and transmit that content solely to operate and improve the Service for you. You are responsible for the content you upload and for having the rights to it. You can export or delete your data at any time from your account settings.

6.Third-party services and AI

The Service interoperates with third-party tools and hardware (such as N.I.N.A., ASCOM/Alpaca, INDI, and your devices). Your use of those tools is governed by their own terms, and we are not responsible for them.

AI features are bring-your-own-key: you supply your own Anthropic API key, and your use of those features is also subject to Anthropic's terms and policies. You are responsible for any usage and charges incurred under your key.

7.Equipment and observatory safety

This is important. Astryx provides planning information and read-only status. It is a decision-support tool, not a safety system. You are solely responsible for the safe setup, supervision, and operation of your telescope, mount, camera, dome or roof, power, and all other equipment, and for protecting them against weather, collisions, power loss, and other hazards.

Do not rely on Astryx as the sole safeguard for unattended operation. Always use appropriate hardware-level protections (limits, safety monitors, weather and power cutoffs). To the maximum extent permitted by law, Astryx is not liable for damage to equipment, loss of data or images, missed acquisition, or other losses arising from your use of the Service.

8.Availability and changes

The Service is under active development and is provided on an "as available" basis. We may add, change, or remove features, and we do not guarantee any particular uptime or that the Service will be uninterrupted or error-free. We may perform maintenance that temporarily limits availability.

9.Fees

Some features may be offered free of charge and others as paid plans. If we introduce fees for features you use, we will give you notice and an opportunity to review the pricing before you are charged. Paid-plan terms (including billing and refunds) will be presented at the point of purchase.

10.Termination

You may stop using the Service and delete your account or workspaces at any time from your account settings. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or for prolonged inactivity, generally with notice where practicable. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will survive.

11.Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be accurate, reliable, secure, or available at any particular time, or that planning outputs and telemetry will be error-free.

12.Limitation of liability

To the maximum extent permitted by law, Astryx and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, images, or equipment, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $50.

13.Indemnification

You agree to indemnify and hold harmless Astryx and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

14.Governing law

These Terms are governed by the laws of the jurisdiction in which Astryx is established, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law gives you the right to bring proceedings in your home jurisdiction.

15.Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.
